Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MOVA online store, including purchases, content, features, and services made available through the store (collectively, the "Services"). In these Terms, "MOVA," "we," "us," and "our" refer to the operator of the MOVA online store. "You" refers to the customer or visitor using the Services.
Please read before using the store. By visiting the store, creating an account, submitting an order, or otherwise using the Services, you agree to these Terms and to any policies linked or posted in the store, including the Return and Refund Policy and Privacy Policy. If you do not agree, do not use the Services.
These Terms are intended for customers of the MOVA online store. Separate written terms may apply to wholesale, collaboration, or other business arrangements.
1. Eligibility and acceptance
You must be at least the age of legal majority where you live, or use the Services with the permission and supervision of a parent or legal guardian. If you use the Services for a business or organization, you confirm that you have authority to bind it to these Terms.
Our acceptance of an order is subject to these Terms and any additional terms shown at checkout. Your use of the Services may also be subject to mandatory laws in your location.
2. Store use and accounts
You agree to provide current, complete, and accurate information when you place an order or create an account. You are responsible for keeping your login information confidential and for activity conducted through your account. Tell us promptly through the store's Contact page if you believe your account is being used without permission.
You may use the Services only for lawful personal or business purposes consistent with these Terms. We may refuse service, restrict access, or close an account when reasonably necessary to protect customers, MOVA, or the integrity of the Services.
3. Product information and availability
We aim to describe and display products accurately. Colors and appearance may vary by screen, lighting, and device. Measurements and sizing guidance are approximate unless expressly stated otherwise. Minor variations that do not materially change the product may occur.
Products and quantities are subject to availability. We may limit sales by customer, household, geographic region, or order; discontinue a product; or correct errors in descriptions, images, pricing, promotions, or availability. If a correction materially affects an order you already placed, we will notify you and provide an appropriate option, which may include cancellation and a refund.
4. Prices, taxes, and payment
Prices are shown in the currency displayed by the store and may change without notice. The amount due at checkout includes the product price and any applicable taxes, shipping charges, discounts, and other disclosed fees. You authorize us and our payment providers to charge the payment method you select.
You represent that you are authorized to use the payment method and that the information you submit is accurate. A payment authorization or confirmation message does not necessarily mean we have accepted the order.
5. Orders, verification, and cancellation
We may accept, reject, or cancel an order for legitimate reasons, including suspected fraud, payment failure, inventory error, pricing error, shipping restriction, or violation of these Terms. We may request information reasonably needed to verify an order.
If we cancel an order after payment, we will refund the amount paid for the canceled item or order to the original payment method. Processing time may depend on your financial institution. Requests to change or cancel an order are not guaranteed once processing has begun.
6. Shipping and delivery
Available destinations, shipping methods, charges, and estimated delivery windows are shown at checkout. At launch, MOVA may offer shipping only within the United States. An order cannot be completed for a destination that the checkout does not support.
Delivery dates are estimates, not guarantees. Delays may occur because of carriers, weather, address problems, high volume, or events outside our reasonable control. You are responsible for providing a complete and accurate delivery address. Where permitted by law, risk of loss passes to you when the order is delivered to the address provided. Contact us promptly if a package is lost, damaged, or marked delivered but not received.
7. Returns and refunds
Returns, exchanges, eligibility conditions, time limits, return shipping, and refund timing are governed by the Return and Refund Policy posted on the store. That policy is incorporated into these Terms. If these Terms conflict with the Return and Refund Policy on a return-specific issue, the Return and Refund Policy controls.
Nothing in these Terms limits a refund, remedy, or cancellation right that cannot be excluded under applicable law.
8. Discounts, promotions, and gift offers
Promotions may be subject to separate conditions, dates, eligibility rules, minimum purchases, exclusions, and availability limits. Unless stated otherwise, offers cannot be combined, applied retroactively, redeemed for cash, or transferred. We may modify or end a promotion when permitted by law, including to correct an error or prevent misuse.
9. Intellectual property
The Services and their content - including the MOVA name and branding, text, graphics, photographs, product descriptions, layout, and design - are owned by or licensed to MOVA and protected by applicable intellectual property laws. You may view and use the store for personal shopping purposes. You may not copy, reproduce, modify, distribute, sell, exploit, or create derivative works from store content without prior written permission, except where law allows.
10. Reviews, photos, and other submissions
If you voluntarily submit a review, comment, photo, idea, or other content, you keep any ownership rights you have. You grant MOVA a worldwide, non-exclusive, royalty-free license to host, reproduce, display, adapt for formatting, and use that content in connection with the store, products, and marketing, subject to applicable law and our Privacy Policy.
You confirm that you have the rights needed to submit the content and that it is accurate, lawful, and does not violate another person's rights. We may moderate or remove submissions that violate these Terms, while respecting any rights that cannot be waived.

You may not use the Services to:

12. Third-party services and links
The Services may rely on third parties for hosting, payment processing, analytics, shipping, social media, or other functions. Those services may have their own terms and privacy practices. MOVA does not control third-party websites and is not responsible for their independent content, availability, or practices.
Your dealings with a third party are between you and that party. Review applicable third-party terms before using an external service or link.
13. Service and product disclaimers
To the fullest extent permitted by law, the Services are provided on an "as available" basis. We do not promise that the store will always be uninterrupted, secure, error-free, or suitable for every purpose. We may update, suspend, or discontinue features of the Services.
These disclaimers do not exclude warranties, remedies, or consumer protections that cannot legally be excluded. Any product warranty expressly provided with an item remains subject to its stated terms.
14. Limitation of liability
To the fullest extent permitted by law, MOVA and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunity arising from or related to the Services.
To the fullest extent permitted by law, MOVA's total liability for a claim arising from the Services will not exceed the amount you paid to MOVA for the product or order giving rise to the claim. These limits do not apply where prohibited, including to liability that cannot legally be limited or excluded.
15. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless MOVA and its owners, employees, contractors, affiliates, and service providers from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Services, your breach of these Terms, or your violation of another person's rights.
16. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access when reasonably necessary because of misuse, fraud, security risk, legal obligation, or a material breach of these Terms. Provisions that by their nature should survive termination will survive, including payment obligations, intellectual property provisions, disclaimers, liability limits, indemnification, and general legal terms.
17. General legal terms
Governing law. These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules, except where mandatory law in your location requires otherwise. Subject to those mandatory rights, disputes may be brought in the state or federal courts serving Cook County, Illinois, and each party consents to their jurisdiction.
Entire agreement; severability. These Terms and incorporated store policies are the entire agreement regarding the Services. If any provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remainder will continue in effect.
No waiver; assignment. A delay in enforcing a right is not a waiver. You may not assign these Terms without our written consent. We may assign them as part of a merger, sale, reorganization, or transfer of the store, subject to applicable law.
18. Changes and contact
We may update these Terms from time to time. The revised version will be posted with a new effective date and will apply prospectively. If a change materially affects an existing order, the terms accepted when that order was placed will continue to govern that order unless law requires otherwise.
